Description:

The course Fundamentals of European Private Law deals with the impact of EU law on various spheres of national private law. This course studies the principles of European private law, as well as directives that are the main legal source of European private law. The impact of EU directives is evident in the field of consumer protection, intellectual property, electronic commerce and certain segments of contract law, so this matter is the subject of the Fundamentals of European Private Law.

Cognitive Skills:

Knowledge and understanding

After successfully completing the course, students will be able to:

- define and explain the concept of European private law,

- define the area of application of European private law,

- define and explain legal sources and individual institutes and concepts of European private law (introduction and principles, law of obligations aspects of electronic trade, consumers' protection, intellectual property, European contract law)

- explain how European private law influences Croatian civil law.

Application

After successfully completing the course, students will be able to:

- properly interpret rules that regulate European private law, as well as implementation regulations in Croatian law,

- resolve the problem of possible lack of adjustment of Croatian law with EU law,

- apply legal rules to concrete life situations.

Analysis

After successfully completing the course, students will be able to:

- analyse legal sources and legal rules that regulate European private law and implementation regulations in Croatian law,

- analyse practice of the European Court

- connect legal rules that regulate different institutes of European private law,

- analyse concrete facts and distinguish between relevant and irrelevant facts in order to adequately apply legal rules

Synthesis

After successfully completing the course, students will be able to:

- connect relevant facts with legal rules and on the basis of that determine legal position of legal subjects,

- critically evaluate individual solutions of European private law,

- prepare material for solving a concrete case.

Evaluation

After successfully completing the course, students will be able to:

-- compare European private law with Croatian civil law,

- recommend an optimal manner to realise subjective civil rights,

- assess successfulness of the implementation of European private law in Croatian law,

- conclude to which extent is Croatian law harmonised with European private law.

Practical and Generic Skills:

After successfully completing the course, students will be able to:

- find relevant legal sources,

- research European Court practice,

- express their own opinion about the application of legal rules to concrete cases,

- formulate contents of written petitions and other legal acts which serve for the purpose of realisation and protection of subjective rights in the area of European private law.

Matching Assessments to Learning Outcomes:

Learning outcomes are tested by an oral examination. the examination consists of an interview wiwth the student within which learning outcomes connected with knowledge and understanding, application, analysis, synthesis and evaluation are tested. A written report of the students about court practice preceded the examination. In the report students outline concrete problems land-registry judges are faced with. E-learning system Merlin is used for the distribution of teaching materials.
